These Terms and Conditions set out the basis on which Waste Clearance Haringey provides waste clearance and rubbish removal services to domestic and commercial customers. By making a booking, accepting a quotation, or allowing our operatives to commence work, you agree to be bound by these Terms and Conditions.
If you do not agree to these Terms and Conditions, you must not use our services.
In these Terms and Conditions, the following words have the meanings given below:
Customer means the person, firm or company requesting our services.
Services means any waste clearance, rubbish removal, bulky waste collection, loading, transportation, or associated services provided by Waste Clearance Haringey.
Waste means any items, materials, junk, rubbish or refuse which the Customer asks us to remove, subject to the exclusions in these Terms and Conditions and applicable waste regulations.
Agreement means the contract between the Customer and Waste Clearance Haringey comprising these Terms and Conditions and any written or verbal quotation or confirmation.
Waste Clearance Haringey provides waste clearance and rubbish removal services, including but not limited to household clearances, garden waste removal, office clearances and general waste collection. The exact scope of Services for each job will be as set out in our quotation and confirmed at the time of booking.
We reserve the right to refuse to remove any items that we reasonably believe to be hazardous, illegal, unsafe to handle, excessively heavy or otherwise beyond the scope of our standard waste clearance service. This includes but is not limited to certain chemicals, asbestos, clinical waste, pressurised containers, explosives and any items prohibited under UK waste regulations.
3.1 Requests for Service
Customers may request Services via telephone, email or other communication channels we make available. We may ask for photographs, descriptions of the waste, property access details and contact information to provide an accurate quotation.
3.2 Quotations
Any quotation we provide is based on the information supplied by the Customer and is normally an estimate. Final pricing may be adjusted on arrival if the volume, type or weight of waste differs from the description, or if access is significantly more difficult than advised.
Quotations are not binding until confirmed by us and may be subject to change if the Customer alters the requirements of the job.
3.3 Booking Confirmation
A booking is regarded as confirmed when we have agreed a date and time window for the Service and the Customer has accepted the pricing basis, either verbally or in writing. We may require contact details, the service address and any relevant access information prior to confirmation.
We reserve the right to refuse or cancel any booking at our discretion, including where we are unable to safely or lawfully carry out the requested work.
The Customer must ensure that we have safe, reasonable and timely access to the premises and to the Waste to be removed. This includes providing any keys, codes, parking arrangements or permissions needed to allow our vehicle and operatives to perform the Service.
Where parking charges, congestion charges or access fees apply, these may be added to the final invoice unless otherwise agreed in advance.
The Customer is responsible for:
Ensuring that any Waste presented for collection is reasonably accessible and does not create undue health and safety risks.
Advising us of any items that require special handling.
Obtaining any permissions required from landlords, managing agents or local authorities in relation to the clearance.
If we are prevented from carrying out the Service because of inadequate access or information, we may charge a call-out or waiting fee.
5.1 Pricing Basis
Our prices are typically based on a combination of factors, which may include the volume of waste, weight, type of materials, labour time, and any additional services requested. The applicable pricing structure will be explained at the time of quotation.
All prices are quoted in pounds sterling and are exclusive of any applicable taxes unless stated otherwise.
5.2 Payment Terms
Unless otherwise agreed in writing, payment is due immediately upon completion of the Service. We may accept payment by cash, card or bank transfer. For commercial Customers or larger projects, we may agree alternative payment terms in writing.
We reserve the right to withhold removal or to suspend or cancel Services if payment is not made in accordance with these Terms and Conditions.
5.3 Late Payments
If the Customer fails to pay any amount due, we may charge interest on overdue sums at the prevailing statutory rate and recover any reasonable costs incurred in pursuing the debt.
6.1 Customer Cancellations
The Customer may cancel or reschedule a booking by giving us reasonable notice. Where cancellation is received at least 24 hours before the scheduled arrival time, no cancellation fee will normally apply.
If the Customer cancels or significantly alters the booking with less than 24 hours notice, we reserve the right to charge a cancellation fee or call-out fee to cover our costs and loss of opportunity. This may be up to a reasonable proportion of the quoted price.
6.2 Our Right to Cancel or Reschedule
We may cancel or reschedule a booking where we are unable to attend due to circumstances beyond our reasonable control, including but not limited to severe weather, vehicle breakdown, staff illness, accidents, or other operational issues.
We may also cancel or suspend the Service if:
The Customer has provided misleading or incomplete information.
We consider it unsafe or unlawful to proceed.
The Customer behaves in an abusive or threatening manner towards our staff.
In such cases, we will seek to notify the Customer as soon as reasonably practicable and offer an alternative appointment where possible. We will not be liable for any loss incurred due to such cancellation or rescheduling, except as required by law.
7.1 Compliance with Law
Waste Clearance Haringey operates in accordance with applicable UK waste legislation and guidance, including the duty of care for controlled waste. We will transport and dispose of Waste only at licensed facilities and via authorised channels.
7.2 Prohibited and Restricted Items
We are not permitted to handle certain categories of waste, including but not limited to:
Asbestos or materials containing asbestos.
Clinical or medical waste.
Hazardous chemicals, solvents or oils beyond standard household quantities.
Explosives, ammunition or highly flammable materials.
Pressurised gas cylinders not certified as safe for collection.
Any item which, in our reasonable opinion, poses a risk to health, safety or the environment.
If such items are discovered during the Service, we may refuse to remove them and may still charge for any work completed or time spent on site.
7.3 Ownership and Title
By presenting Waste for collection, the Customer confirms they are entitled to dispose of it and that the Waste does not belong to any third party without permission. Title to the Waste passes to us once it is loaded onto our vehicle, at which point we assume responsibility for its lawful transport and disposal.
The Customer warrants that:
They are either the owner or authorised agent of the owner of the premises and the Waste.
The Waste does not include prohibited materials as described in these Terms and Conditions.
The information given to us about the Waste and access conditions is accurate and complete.
If any of these warranties are breached, the Customer may be held liable for any loss, damage, penalty or cost that we incur as a result.
9.1 General Liability
We will exercise reasonable care and skill in providing the Services. However, we will not be liable for:
Any pre-existing damage to the Customer’s property or premises.
Minor cosmetic damage which is reasonable and unavoidable when removing bulky items through restricted spaces.
Loss or damage arising from inaccurate or incomplete information supplied by the Customer.
Any loss, damage, cost or expense that is not a reasonably foreseeable consequence of our breach of contract or negligence.
9.2 Limits on Liability
Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be limited or excluded.
Subject to the above, our total liability to the Customer for any loss or damage arising from or in connection with the Services shall be limited to the amount paid or payable by the Customer for the specific Service giving rise to the claim.
9.3 Indirect Loss
We will not be liable for any indirect or consequential losses, including but not limited to loss of profits, loss of business, loss of contracts or loss of opportunity, even if such losses were foreseeable.
Waste Clearance Haringey maintains appropriate insurance cover for public liability and, where applicable, employer’s liability in connection with the performance of our Services. Details of our insurance arrangements are available on request.
If you are dissatisfied with any aspect of our Service, you should notify us as soon as possible, preferably within 48 hours of completion. We will investigate any reasonable complaint and seek to resolve it promptly and fairly.
Where a dispute cannot be resolved directly between us, both parties agree to consider mediation or another form of alternative dispute resolution before commencing formal legal proceedings, where this is appropriate and practical.
We will collect and process personal information about Customers only to the extent necessary to manage bookings, provide the Services, arrange payment and comply with our legal obligations. We will handle personal data in accordance with applicable data protection laws.
We will not sell or share Customer information with third parties except as necessary to deliver the Service, process payments, comply with the law or with the Customer’s consent.
We shall not be in breach of these Terms and Conditions nor liable for any delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control. These may include extreme weather, natural disasters, strikes, lock-outs, accidents, road closures, or disruptions to utilities or transport networks.
Where a force majeure event occurs, we will use reasonable endeavours to notify the Customer and to reschedule the Service once conditions allow.
We may update or amend these Terms and Conditions from time to time to reflect changes in the law, our business operations or the Services we offer. The version in force at the time of the Customer’s booking will apply to that booking.
It is the Customer’s responsibility to review the current Terms and Conditions before confirming a new booking.
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be deemed deleted, but such finding shall not affect the validity and enforceability of the remaining provisions.
These Terms and Conditions, together with any quotation or written confirmation provided, constitute the entire Agreement between the Customer and Waste Clearance Haringey in relation to the Services and supersede any prior understandings, representations or agreements, whether oral or written.
These Terms and Conditions and any dispute or claim arising out of or in connection with them, or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of our waste clearance and rubbish removal Services.
